Costs

We charged a fixed collection commission (available on request) less any commission which may be payable to us in terms of the Debt Collectors Act 114 of 1998 or to Bentley Attorneys in terms of the Magistrate ' s Court Act 32 of 1944.

The only exception arises when the matter has to be handed over to the Bentley Attorneys. We pay all the attorneys fees in undefended matters, but reserve the right to charge you for the attorney's disbursements (i.e. payments that have been made to third parties, e.g. revenue stamps, sheriffs, agent attorneys and legal advertising) in undefended matters and should a matter be defended the matter will be 'ceded' back to you for you to instruct the attorneys directly in the matter and bear the costs.
